Remote Control for TV – Play +

These Terms of Service (“Terms”) govern your use of the Remote Control for TV – Play + mobile application (the “App”) operated by Collabrains Technologies LTD (“we,” “us,” or “our”).

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Use of the App

The App allows users to control compatible smart TVs and related devices through supported remote-control features and other in-app functionality.

You agree to use the App only for lawful purposes and in accordance with these Terms. You may not:

  • use the App in any way that violates applicable laws or regulations;
  • interfere with or disrupt the App or its related systems;
  • attempt to gain unauthorized access to any part of the App or its services;
  • copy, modify, distribute, sell, or lease any part of the App except as permitted by law.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your country, to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with permission from a parent or legal guardian.

3. Subscription, Billing, and Free Trial

Certain features of the App may require a paid subscription. Subscription details, including pricing, billing period, and included features, are displayed in the App before purchase.

Free Trial

We may offer a free trial for certain subscription plans. If offered, the free trial provides access to subscription features for the period shown in the App.

Unless canceled at least 24 hours before the end of the free trial period, your subscription may automatically renew into a paid subscription through your Apple ID account.

Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.

Managing Subscriptions

You can manage or cancel your subscription in your Apple device account settings after purchase.

Refunds

Payments are processed by Apple. Refund requests are subject to Apple’s payment and refund policies.

4. No Personal Information Collected

We do not collect personal information from users through the App.

The App is designed so that we do not knowingly collect data such as your name, email address, phone number, mailing address, or other directly identifying information.

5. Firebase and Technical Services

The App may use Firebase services provided by Google to support app functionality, such as crash reporting, analytics, performance monitoring, or other technical operations.

These services are used only to support and improve the App. We do not use them to identify you personally.

Depending on the Firebase services enabled in the App, limited technical or device-related data may be processed automatically by those services, such as app performance events, crash logs, device type, app version, or similar diagnostic information. Such data is used only for operational, security, stability, and improvement purposes.

Your use of the App is also subject to any applicable third-party platform terms, including Apple’s terms and any relevant Google/Firebase terms.

6. Compatibility and Device Requirements

The App is intended to work only with supported devices, operating systems, networks, and compatible TV models. We do not guarantee that the App will work with every television, streaming device, or hardware configuration.

App performance may depend on your Wi-Fi network, local device settings, software version, and third-party device compatibility.

7. Third-Party Devices and Services

The App may interact with third-party TVs, smart devices, platforms, or software. We are not responsible for the availability, behavior, security, or functionality of third-party devices or services.

Brand names, product names, and trademarks of televisions or device manufacturers remain the property of their respective owners. The App is an independent application and is not necessarily affiliated with, endorsed by, or sponsored by any TV manufacturer or platform unless explicitly stated.

8. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

You do not acquire any ownership rights in the App. All rights not expressly granted are reserved by us.

9. Intellectual Property

The App, including its design, text, graphics, logos, software, and other content, is owned by or licensed to us and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the App except as expressly permitted under these Terms.

10. Prohibited Conduct

You agree not to:

  • reverse engineer, decompile, or disassemble the App, except where allowed by law;
  • use bots, scripts, or automated methods to access or interact with the App;
  • remove or alter copyright, trademark, or other proprietary notices;
  • use the App in a way that could damage, disable, overburden, or impair the App or related infrastructure.

11. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.

We do not guarantee that:

  • the App will always be available, uninterrupted, or error-free;
  • the App will be compatible with all TVs or devices;
  • defects or errors will always be corrected.

12. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, business, or goodwill arising from or related to your use of or inability to use the App.

If applicable law does not allow certain limitations, our liability will be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless Collabrains Technologies LTD from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

  • your use or misuse of the App;
  • your violation of these Terms;
  • your violation of any law or the rights of a third party.

14. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if continued operation of the App is no longer commercially or technically feasible.

You may stop using the App at any time by uninstalling it.

15. Changes to the App or These Terms

We may update, modify, or discontinue the App or any part of it at any time.

We may also revise these Terms from time to time. Updated Terms become effective when posted in the App or otherwise made available. Your continued use of the App after the updated Terms take effect means you accept the revised Terms.

16. Governing Law

These Terms are governed by the laws of CA, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the App shall be resolved in the courts located in CA, unless otherwise required by applicable consumer law.

17. Apple App Store Terms

If you downloaded the App from the Apple App Store, you acknowledge that:

  • these Terms are between you and us, not with Apple;
  • Apple is not responsible for the App or its content;
  • Apple has no obligation to provide maintenance or support services for the App;
  • to the extent any warranty exists by law and is not effectively disclaimed, Apple may be notified, and Apple may refund the purchase price, if any, for the App;
  • Apple is a third-party beneficiary of these Terms and may enforce them against you.
