End User License Agreement (EULA) for Budget Tracker & Planner Ultra

Effective Date: 15.07.2024

This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and Collabrains Technologies LTD for the use of the Budget Tracker & Planner Ultra application (“App”). By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this Agreement.

1. Acceptance of Terms

By accessing or using the App, you agree to comply with and be bound by this Agreement. If you do not agree to the terms of this Agreement, do not download, install, or use the App.

2. License Grant

The Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with this Agreement.

3. Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or disassemble the App.
  • Rent, lease, loan, sell, sublicense, or distribute the App or any part thereof.
  • Use the App to transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content.
  • Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party’s use of the App.

4. Ownership

The App is licensed, not sold. The Company retains all rights, title, and interest in and to the App, including all intellectual property rights therein. Your use of the App does not grant you any ownership rights to the App.

5. Privacy

Your use of the App is subject to the Company’s Privacy Policy, which is incorporated by reference into this Agreement. By using the App, you agree to the collection, use, and sharing of your information as described in the Privacy Policy.

6. In-App Purchases and Subscriptions

The App offers in-app purchases, including subscriptions. By purchasing a subscription, you agree to the following terms:

  • Payment: Payment will be charged to your iTunes account at confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Management: You can manage or turn off auto-renewal in your Account Settings after purchase.
  • Cancellation: You may cancel your subscription at any time. If you cancel, your subscription will stop at the end of the current billing cycle.

7. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies of the App from your devices.

8. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranty of any kind. The Company disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the App by any third party; (d) any errors or omissions in any content; and (e) any other matter relating to the App.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of USA,CA, without regard to its conflict of law principles.

11. Changes to This Agreement

The Company reserves the right to modify this Agreement at any time. Any changes will be posted on this page, and the effective date will be updated accordingly. Your continued use of the App after any changes constitutes your acceptance of the new terms.
