Car Play Connect – Smart Dash

These Terms of Use and End User License Agreement (“Terms”) govern your use of the Car Play Connect – Smart Dash mobile application (the “App”) provided by Collabrains Technologies LTD. (“we”, “us”, or “our”).

By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree, do not download, install, or use the App.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to:

Download and install a copy of the App on an iOS device that you own or control, and
Use the App solely for your personal, non-commercial use, in accordance with these Terms and the usage rules set forth in the Apple App Store Terms of Service.

You acknowledge that the App is licensed, not sold, to you.

2. Eligibility

You must:

Be at least the age of majority in your jurisdiction, or
Have the consent of a parent or legal guardian,

to use the App. By using the App, you represent that you meet these requirements.

3. Use While Driving – Safety Warning

The App may provide information and controls that could distract you if used improperly.

You must not interact with the App in any way that distracts you from driving or violates traffic laws.
You are solely responsible for operating your vehicle safely and in full compliance with all applicable laws and regulations.
Where available, rely on Apple CarPlay or voice controls and avoid manual interaction with the phone while driving.

We are not responsible for any accidents, damages, injuries, or legal consequences resulting from your use of the App while operating a vehicle.

4. Permissions & Data

The App may request access to certain features of your device for functionality, including but not limited to:

Contacts / Phone Book – To allow quick contact access within the App / CarPlay interface.
Location – To provide navigation and location-based features.

You may enable or disable these permissions via your device settings. Certain features may not be available if permissions are disabled.

Our handling of data is described in detail in our Privacy Policy, which forms part of these Terms. By using the App, you also agree to the Privacy Policy.

5. In-App Purchases & Subscriptions

The App may offer in-app purchases and subscription-based features (“Paid Features”).

5.1 Payments via Apple

All payments and subscriptions are processed by Apple through your Apple ID account.
By making a purchase, you agree to Apple’s terms, conditions, and billing practices.
We do not have access to your full payment details.

5.2 Subscriptions, Renewals, and Cancellations

Some features may be offered as auto-renewing subscriptions.
The subscription term (e.g., weekly, monthly, yearly), pricing, and available free trials are displayed in the App and/or on the App Store product page.
Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
You can manage or cancel your subscriptions at any time in your Apple ID settings:
- Settings > [your name] > Subscriptions on your iOS device.
Deleting the App does not cancel your subscription. You must cancel via Apple’s subscription management.

5.3 Free Trials

If a free trial is offered:

If you do not cancel before the end of the trial period, you may be automatically charged for the subscription at the then-current price.
Trial eligibility and conditions are determined by Apple and our current offering.

5.4 Refunds

Refunds for in-app purchases or subscriptions are generally handled by Apple, not by us.

Please refer to Apple’s refund policies and procedures.

6. Prohibited Uses

You agree not to:

Copy, modify, adapt, translate, or create derivative works of the App.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except as permitted by law.
Circumvent, disable, or interfere with security-related features of the App.
Use the App for any unlawful, harmful, fraudulent, or malicious purpose.
Use the App in a manner that could damage, disable, overburden, or impair the App or interfere with any other party’s use of the App.
Rent, lease, lend, sell, redistribute, or sublicense the App.

7. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to:

Software, graphics, user interface, design, features, and
Logos, trademarks, and other content,

are owned by us or our licensors and are protected by intellectual property laws.

You do not acquire any ownership rights in the App or its content under these Terms.

8. Third-Party Services & CarPlay

The App may:

Integrate with Apple CarPlay or other Apple services.
Show content or interact with features provided by Apple or other third parties.

You acknowledge that:

Those services are governed by their own terms and privacy policies.
We do not control and are not responsible for third-party services, networks, or content.

9. Disclaimers

To the maximum extent permitted by applicable law, the App is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to:

Implied warranties of merchantability,
Fitness for a particular purpose,
Non-infringement, and
Title.

We do not warrant that:

The App will be error-free or uninterrupted.
Any defects will be corrected.
The App will be compatible with all devices or operating systems.
The information displayed by the App (e.g., location data, contact access, or navigation-related information) is always accurate, complete, or up-to-date.

You use the App at your own risk, especially while operating a vehicle.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall we, our directors, employees, partners, or licensors be liable for:

Any indirect, incidental, special, consequential, or punitive damages,
Any loss of profits, data, or goodwill,
Any loss or damage resulting from:
- Your access to or use of the App,
- Your inability to use the App,
- Any conduct or content of any third party,
- Use of the App while driving or operating a vehicle.

11. Indemnification

You agree to indemnify, defend, and hold harmless Collabrains Technologies LTD., its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

Your access to or use of the App,
Your violation of these Terms, or
Your violation of any law or the rights of a third party.

12. Termination

These Terms are effective until terminated by you or us.

We may, at any time and without notice, suspend or terminate your access to the App if:

You violate these Terms, or
We decide to discontinue the App or certain features.

Upon termination:

The license granted to you under these Terms will immediately end.
You must stop using the App and delete it from your devices.

Sections which by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.

13. Changes to the App and to These Terms

We may:

Update or modify the App (including adding, removing, or changing features) at any time, and/or
Update these Terms.

If we make material changes:

We will update the “Last Updated” date at the top, and
We may notify you via the App, the App Store, or other reasonable means.

Your continued use of the App after the changes become effective constitutes your acceptance of the updated Terms.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Country / State], without regard to its conflict of laws principles.

Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in California, unless applicable law requires a different venue.
