MOT Check Terms of Use

ACCEPTANCE OF TERMS

By downloading, installing, or using the MOT Check mobile application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

DESCRIPTION OF SERVICE

MOT Check is a mobile application that provides access to UK vehicle MOT history information through the UK government’s MOT History API. The App allows users to:

Search for vehicle MOT history using registration numbers
Save and manage vehicle information locally on their device
Set MOT expiry reminders
Track maintenance records and fuel consumption (optional)
Access premium features through subscription

ELIGIBILITY

You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

USER ACCOUNT AND REGISTRATION

The App does not require user account creation or registration. All data is stored locally on your device.

USER RESPONSIBILITIES

You agree to:

Provide accurate vehicle registration numbers when searching
Use the App in compliance with all applicable laws and regulations
Not use the App for any unlawful or unauthorized purpose
Not attempt to reverse engineer, decompile, or disassemble the App
Not use automated systems or bots to access the App
Not interfere with or disrupt the App’s functionality
Respect intellectual property rights

DATA ACCURACY

The MOT history data provided by the App is sourced from the UK government’s official MOT History API. While we strive to provide accurate information:

We do not guarantee the accuracy, completeness, or reliability of the data
The data is provided “as is” from the UK Driver and Vehicle Standards Agency (DVSA)
You should verify critical information through official channels
We are not responsible for any errors or omissions in the MOT data

SUBSCRIPTIONS AND PAYMENTS

Premium Features:
MOT Check offers optional premium subscriptions with the following plans:

Weekly Premium: $4.99 per week
Monthly Premium: $9.99 per month
Yearly Premium: $49.99 per year

Subscription Terms:

All subscriptions are auto-renewable
Payment is charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your Apple ID Account Settings
Cancellation takes effect at the end of the current billing period
No refunds are provided for unused portions of subscription periods
Any unused portion of a free trial period will be forfeited when you purchase a subscription

Pricing:

All prices are in US Dollars unless otherwise stated
Prices are subject to change with notice
Price changes do not affect existing subscriptions until renewal

INTELLECTUAL PROPERTY

Ownership:
The App, including all content, features, functionality, design, text, graphics, logos, and software, is owned by Collabrains Technologies LTD and is protected by international copyright, trademark, and other intellectual property laws.

License:
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes.

Restrictions:
You may not:

Copy, modify, or create derivative works of the App
Distribute, sell, lease, or sublicense the App
Remove or alter any copyright, trademark, or proprietary notices
Use the App for commercial purposes without authorization

PROHIBITED USES

You may not use the App to:

Violate any applicable laws or regulations
Infringe upon the rights of others
Transmit any harmful or malicious code
Collect or harvest data from other users
Impersonate any person or entity
Engage in any fraudulent activity
Overload or interfere with the App’s infrastructure

DISCLAIMERS

NO WARRANTY:
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

NO GUARANTEE:
We do not warrant that:

The App will be uninterrupted, secure, or error-free
Defects will be corrected
The App is free from viruses or harmful components
The results obtained from using the App will be accurate or reliable

VEHICLE INFORMATION:
The MOT data provided is for informational purposes only and should not be solely relied upon for making decisions about vehicle purchases, safety, or roadworthiness.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
We are not liable for any loss of profits, revenue, data, or business opportunities
We are not responsible for decisions made based on information provided by the App

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Collabrains Technologies LTD. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another party
Your violation of any applicable laws or regulations

THIRD-PARTY SERVICES

UK MOT History API:
The App uses the UK government’s MOT History API. Your use of MOT data is subject to the UK government’s terms and conditions. We are not responsible for the availability, accuracy, or reliability of the government API.

Apple Services:
In-app purchases and subscriptions are processed through Apple’s App Store. You agree to comply with Apple’s Terms of Service and applicable App Store terms.

TERMINATION

We reserve the right to:

Suspend or terminate your access to the App at any time, with or without cause
Modify or discontinue the App at any time without notice
Refuse service to anyone for any reason

You may terminate your use of the App by:

Uninstalling the App from your device
Canceling any active subscriptions

Upon termination:

Your license to use the App immediately ceases
All locally stored data will be deleted when you uninstall the App
Subscription cancellation follows Apple’s standard procedures

CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

Updating the “Last Updated” date at the top
Displaying an in-app notification
Posting the updated Terms within the App

Your continued use of the App after changes constitutes acceptance of the modified Terms.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of California, without regard to its conflict of law provisions.

DISPUTE RESOLUTION

Any disputes arising from these Terms or your use of the App shall be resolved through:

Good faith negotiation between the parties
Binding arbitration if negotiation fails
Courts located in California if arbitration is unavailable

SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Collabrains Technologies LTD. regarding the use of the App and supersede all prior agreements and understandings.

NO WAIVER

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
