1) Acceptance of Terms
By downloading, accessing, or using Premium Music Stations (the “App”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the App.

2) The App and Service Description
The App provides access to curated music and radio streams from third-party sources and may include premium features available through paid subscriptions.
Discovery and catalog. Station listings, names, stream URLs, and related metadata are provided by a third-party discovery service, the Radio Browser project (https://radio-browser.info / https://api.radio-browser.info), which offers a free, open API and catalog data. We use this catalog solely to help you find and access internet radio stations. We do not own or control the Radio Browser service or the underlying catalog data.
Streaming. The App does not host, store, or rebroadcast any audio. When you play a station, your device connects directly to that station’s stream URL. The App acts only as a directory and player. Audio is streamed from the respective broadcasters to you; we do not copy, cache, or redistribute streams.
We do not own or control the third-party stations or streams. Availability, quality, and content may change at any time without notice.

3) Eligibility
You must be able to form a legally binding contract to use the App. If you are under the age required in your country, you may use the App only with a parent/guardian’s permission.

4) Subscriptions, Free Trials, and Billing (In-App Purchases)
A) Billing platform
All purchases are processed by Apple via In-App Purchase. Payment is charged to your Apple ID account at confirmation of purchase.
B) Auto-renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
C) Managing or canceling
You can manage and cancel subscriptions in iOS: Settings → Apple ID → Subscriptions.
Deleting the App does not cancel your subscription.
D) Free trials (if offered)
If you start a free trial, you will be charged when the trial ends unless you cancel before the trial period ends. Free trial eligibility is determined by Apple.
E) Price changes
Apple may change subscription pricing, and we may adjust prices where permitted. If required, you will be notified and asked to consent before any price increase takes effect.
F) Refunds
Purchases and refunds are handled by Apple under Apple’s policies. We cannot issue refunds directly for App Store purchases. You may request a refund through Apple’s support channels.

5) License and Permitted Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use, in accordance with these Terms and Apple’s rules.
You agree not to:
– copy, modify, or create derivative works of the App;
– reverse engineer, decompile, or attempt to extract source code (except where allowed by law);
– use the App in a way that interferes with or disrupts the service;
– bypass paywalls or subscription checks;
– scrape or bulk-download station listings or metadata (unless we explicitly allow it);
– use the App for unlawful activities.

6) Third-Party Content and Streams
Catalog source. Station information and stream links are sourced from the Radio Browser project (https://radio-browser.info). Its catalog data is made available under a public-domain-style license for use in applications. We do not control the accuracy, completeness, or legality of entries in that catalog or of the underlying streams.
Streaming. We do not host or rebroadcast any audio. Playback is a direct connection between your device and the broadcaster’s stream. We are not responsible for third-party content, stream availability, accuracy of station info, or third-party websites or services.
Some streams may:
– be unavailable in certain regions (geo-restrictions),
– contain ads, talk segments, or content you may find objectionable,
– change URLs or go offline.
You use third-party streams at your own risk and may be subject to the broadcasters’ or content owners’ terms.

7) User Content (if applicable)
If you submit content to us (e.g., station suggestions, feedback), you grant us a non-exclusive license to use it to operate and improve the App.

8) Intellectual Property
The App, including its design, code, and branding, is owned by Collabrains Technologies LTD or licensed to us and is protected by intellectual property laws.
Station names, logos, and trademarks belong to their respective owners and are used for identification purposes only. We do not claim any rights in third-party stations, streams, or their branding.

9) Availability and Changes
We may modify, suspend, or discontinue the App or any part of it at any time, including premium features, station listings, or supported streaming formats. We are not liable if any part of the service becomes unavailable.

10) Disclaimers
The App is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee:
– uninterrupted or error-free operation,
– that streams will always be available or playable,
– that content will meet your expectations.

11) Limitation of Liability
To the maximum extent permitted by law, Collabrains Technologies LTD will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue.
Our total liability for any claim relating to the App will not exceed the amount you paid (if any) for the App or subscriptions in the 12 months before the claim, or USD $10, whichever is greater, unless your local law requires otherwise.

12) Indemnification
You agree to indemnify and hold Collabrains Technologies LTD harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App, violation of these Terms, or violation of any rights of a third party.

13) Termination
We may suspend or terminate access to the App if you violate these Terms, misuse the service, or if required by law. You may stop using the App at any time.
Termination does not affect your App Store subscription; you must cancel through Apple.

14) Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect and use information.

15) Governing Law and Dispute Resolution
These Terms are governed by the laws of CA, excluding conflict of law principles.
If you are a consumer, you may have mandatory rights under your local laws that override parts of this section.
Disputes: Any dispute will be brought in the courts located in CA.

16) Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice in the App and/or update the effective date. Continued use after changes means you accept the updated Terms.
