These Terms of Use and End User License Agreement (“Terms” or “EULA”) govern your use of the App. By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1) License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, for personal, non-commercial use, subject to these Terms and Apple’s App Store rules.

2) Apple Terms

You acknowledge that Apple is not a party to these Terms except as a third-party beneficiary (as described below). Your use of the App must comply with the Apple Media Services Terms and Conditions and applicable App Store requirements.

3) The Service (AI Video Generation)

The App lets you submit prompts and related inputs (“Inputs”) to generate AI-created videos and related outputs (“Outputs”) using third-party AI models/providers.

You are responsible for your Inputs. Do not submit sensitive personal data (passwords, financial info, government IDs, medical info) and do not submit content you do not have rights to use.

We do not guarantee that Outputs will be accurate, appropriate, or meet your expectations. Outputs may be incomplete, incorrect, or unsuitable for certain uses.

4) Acceptable Use

You agree not to use the App to create, upload, request, or distribute content that:

  • violates any law or regulation;
  • infringes intellectual property, privacy, or other rights of others;
  • is defamatory, harassing, hateful, or discriminatory;
  • includes sexual content involving minors or exploitation;
  • includes instructions for wrongdoing or illegal activities;
  • impersonates any person or entity or misleads others about affiliation;
  • attempts to bypass safety filters or restrictions.

We may suspend or terminate access if you violate these Terms or misuse the App.

5) User Content, Inputs, and Outputs

  • Inputs: You retain your rights in your Inputs. You grant us and our service providers the right to process your Inputs to operate the App and generate Outputs.
  • Outputs: To the extent allowed by law, you may use Outputs for lawful purposes. You are responsible for reviewing Outputs and ensuring they comply with laws and third-party rights (copyright, publicity, trademarks, etc.).

Third-party provider processing: Your Inputs may be processed by third-party AI model providers. Their terms and policies may apply.

6) Intellectual Property

The App (including its code, design, trademarks, and branding) is owned by us or licensed to us. You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the App except where permitted by law.

Third-party trademarks and logos belong to their respective owners and are used only for identification, if displayed.

7) Subscriptions and In-App Purchases

If the App offers paid features, purchases are handled by Apple In-App Purchase.

  • Payment is charged to your Apple ID at confirmation of purchase.
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours before the end of the current period.
  • You can manage/cancel in Settings → Apple ID → Subscriptions.
  • Deleting the App does not cancel your subscription.
  • Refunds are handled by Apple under Apple’s policies.

(If your app has no subscriptions, delete this section.)

8) Third-Party Services

The App may rely on third-party services (e.g., AI model providers, Firebase). We are not responsible for third-party services, their availability, or their content/practices. Third-party services may have their own terms and policies.

9) Availability, Changes, and Termination

We may change, suspend, or discontinue the App (or any part of it) at any time, including features, model availability, and limits. We may also impose usage limits to protect the service.

You may stop using the App at any time.

10) Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUTPUTS ARE ACCURATE, RELIABLE, OR ERROR-FREE, OR THAT THE APP WILL BE UNINTERRUPTED OR SECURE.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $10, WHICHEVER IS GREATER, UNLESS YOUR LOCAL LAW REQUIRES OTHERWISE.

12) Indemnification

You agree to indemnify and hold us harmless from claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the App, your Inputs, your violation of these Terms, or your violation of any rights of a third party.

13) Governing Law

These Terms are governed by the laws of CA, excluding conflict-of-law rules. If you are a consumer, mandatory consumer protections in your jurisdiction may still apply.

14) Changes to These Terms

We may update these Terms from time to time. We will update the effective date and may provide notice in the App. Continued use after changes means you accept the updated Terms.

15) Apple EULA Requirements & Third-Party Beneficiary

You acknowledge and agree that:

  • Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) in accordance with Apple’s policies; to the maximum extent permitted by law, Apple will have no other warranty obligation.
  • Apple is a third-party beneficiary of these Terms and may enforce them against you.
