TERMS OF USE FOR TORQUE PRO

1. ACCEPTANCE OF TERMS

By downloading, installing, or using the Torque Pro application (“App”), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. APP DESCRIPTION

Torque Pro is a vehicle diagnostics application that connects to your vehicle’s OBD2 port to provide diagnostic information, performance data, and sensor readings. The App offers both free and premium subscription features.

3. ACCOUNT REGISTRATION

3.1 You may be required to register for an account to access certain features of the App.

3.2 You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. SUBSCRIPTION SERVICES

4.1 The App offers subscription-based access to premium features including but not limited to: Clear Trouble Codes, Battery Health monitoring, Performance Graphs, Performance Tests, Premium Dashboard Styles, and Premium Gauges.

4.2 Subscription fees are clearly displayed before purchase and will be charged to your Apple ID account.

4.3 Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period.

4.4 Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.5 You can manage and cancel your subscriptions by going to your account settings in the App Store after purchase.

4.6 No refunds will be granted for partial subscription periods.

5. USER RESPONSIBILITIES

5.1 You must use the App in compliance with all applicable laws and regulations.

5.2 You agree not to use the App while operating a vehicle. Vehicle diagnostics should only be performed when the vehicle is safely parked.

5.3 You are responsible for any data or connection charges incurred while using the App.

5.4 You agree not to:

  • Attempt to decompile, reverse engineer, or disassemble the App
    • Use the App for any illegal purposes
    • Interfere with the App’s security features
    • Distribute, copy, or share subscription access with others

6. VEHICLE DATA AND PRIVACY

6.1 The App collects vehicle diagnostic data through the OBD2 connection. This data is stored on your device and, with your consent, may be backed up to your personal cloud storage.

6.2 We do not share your vehicle data with third parties except as required by law or with your explicit consent.

7. INTELLECTUAL PROPERTY

7.1 All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.

7.2 You are granted a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.

8. DISCLAIMER OF WARRANTIES

8.1 THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

8.2 The App is not a substitute for professional vehicle diagnostics or repair. Information provided by the App should be verified by a qualified automotive technician before undertaking any vehicle repairs or modifications.

8.3 We do not warrant that the App will be error-free, uninterrupted, or free from harmful components.

9. LIMITATION OF LIABILITY

9.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP.

9.2 We are not responsible for any vehicle damage, accidents, or injuries that may occur in connection with your use of the App.

10. MODIFICATIONS TO THE APP AND TERMS

10.1 We reserve the right to modify, suspend, or discontinue the App or any features at any time without notice.

10.2 We may update these Terms of Use from time to time. Continued use of the App after any changes constitutes acceptance of the revised terms.

11. TERMINATION

11.1 We may terminate or suspend your access to the App immediately without notice for violations of these Terms.

11.2 Upon termination, your right to use the App will immediately cease.

12. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Torque Pro operates, without regard to its conflict of law provisions.
